Tourist Rental Rules Remain in Force
The ruling does not eliminate regional tourist rental regulations, including those in Andalusia.
If you operate a short-term rental, you must still comply with all applicable regional and local requirements, such as:
- Tourist rental licences
- Regional registration obligations
- Health and safety standards
- Guest registration procedures
- Community and local bylaws
These rules remain fully valid and enforceable.
What the Supreme Court Actually Addressed
The Court’s decision focused specifically on the legality of the national NRUA registry introduced by the central government.
The key issue was whether the state had overstepped its authority by creating a nationwide system in addition to existing regional tourism registries already managed by Spain’s autonomous communities.
Importantly, the ruling concerns administrative jurisdiction, not the legality of tourist rentals themselves.
Regional Registration Still Applies
This is the most important point for property owners:
- Regional regulations remain unchanged
- Regional registration is still mandatory
- Existing tourist rental licences are still required
In regions such as Andalusia, properties must continue complying with VUT/VFT tourism licensing and registration obligations.
What This Means in Practice
For most landlords and investors, little has changed in day-to-day operations.
Operating a short-term rental without proper regional authorisation can still result in:
- Inspections by local authorities
- Fines and sanctions
- Enforcement action
The ruling does not legalise unregistered tourist rentals, nor does it reduce the regulatory powers of regional governments.

Much of the misunderstanding comes from simplified headlines and online commentary suggesting that Spain has “scrapped” or “abolished” tourist rental regulation.
This is inaccurate.
The ruling only affects the national NRUA system and does not alter the regional legal frameworks that govern tourist rentals across Spain.
